Safe Harbor

It is Shire's policy to respect and protect Personal Information collected or maintained by or on behalf of Shire. In furtherance of our commitment, Shire has certified to the US-EU and US-Swiss Safe Harbor Agreements regarding Personal Information collected in the European Economic Area (EEA) and Switzerland in support of Shire's Human Resources (HR), PV operations, and R&D operations. Shire adheres to the Safe Harbor privacy principles and the “Frequently Asked Questions” document, as separately agreed to by the U.S. Department of Commerce and the European Commission, and the Federal Data Protection and Information Commissioner of Switzerland.  To learn more about the Safe Harbor program, and to view Shire’s certification, please visit

Where applicable and appropriate, Shire notifies individuals about the types of Personal Information it collects about them, the purpose for which it collects such information, the types of third parties to which it discloses such information, and how to contact Shire with any inquiries or complaints. Notice is provided in clear and conspicuous language at the time of collection, and before Shire uses or discloses the information for a purpose other than that for which it was originally collected.

In the event Personal Information is to be used for a new purpose other than the purpose for which the information was originally collected, or subsequently authorized or transferred to a third party exercising independent control over the information, individuals are given, where practical and appropriate, an opportunity to decline to have their information so used or transferred. In the event that the information to be used for a new purpose or transferred to the control of a third party is Sensitive Personal Information, the individual's explicit consent will be obtained prior to the use or transfer of the information.

Onward Transfers
Shire will only provide Personal Information to an Agent where the Agent has written agreement that they provide at least the same level of privacy protection as is required by this policy. Where Shire has knowledge that an Agent is using or sharing Personal Information in a way that is contrary to this policy, Shire will take steps to prevent or stop such processing. Shire will only transfer Personal Information to a non-Agent third party where individuals have been provided notice and have given their consent.

Shire takes reasonable and appropriate administrative, technical, and physical precautions to protect the confidentiality, integrity, and availability of Personal Information, whether in electronic or tangible, hard copy form.

Where applicable, individuals have access to their Personal Information and may request corrections, deletions, or additions, as appropriate, and except where the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy or where the rights of persons other than the individual would be violated.

Data Integrity
Shire limits the collection, use, and retention of Personal Information to that which is necessary for the intended purpose for which it was collected, and takes steps to ensure that all Personal Information is reliable, accurate, complete, and current. Shire depends on its Workforce to keep Personal Information reliable, accurate, complete, and current.

Shire has put in place mechanisms to verify ongoing compliance to this policy. Any Agent or Employee who violates this policy will be subject to disciplinary procedures in accordance with the Shire Code of Ethics Policy [06-100GL].

Dispute Resolution
In case of disputes, individuals are able to seek resolution of their questions or complaints regarding use and disclosure of their Personal Information in accordance with this policy. If you feel that Shire is not abiding by this policy or is not in compliance with the Safe Harbor principles, please contact Shire via mail or e-mail as noted in Section J. 

Limitation on Scope of Privacy Statement
Shire adheres to this policy except as required or allowed by law, to meet legal, governmental, law enforcement, or national security obligations, or to protect the health or safety of an individual.
